I. Company
Under the protected brand names SUBEX and SUBEX THE ART OF DIVING, water sports activities are carried out through a company registered in Egypt under the name Sub-Egypt L.L.C. The company is located in Cairo/Egypt. The head office is in Hurghada, Al Dahar. SUBEX operates diving centres at the locations Hurghada/Sahl Hasheesh, Sharm El Sheikh, and El Quseir.
II. Scope of application
The GTC apply to all SUBEX customers, as well as tour operators and/or retailers. For tour operators and/or retailers, the sales conditions for tour operators and/or retailers as specified in the contract shall apply additionally.
III. Prices
SUBEX currency is Swiss franc (CHF). The prices are therefore based on CHF. They are also shown in the currencies Euro (EUR) and US Dollar (USD).
The current prices & conditions are published on the homepage www.subex.org under Prices & Info. The prices published there always apply, unless other agreements have been made in writing.
IV. Payment
We offer the following payment options:
- Advance payment after invoice, the prices are shown in CHF or EUR. After booking, an invoice in CHF or EUR will be issued, which must be paid in the appropriate currency to our account. Payment in advance is possible for bookings made up to 10 days before arrival. The payment deadline is 5 days before arrival. If the customer does not use the service already paid for, a processing fee of 36.00 CHF/EUR per booking will be charged. If a group booking is cancelled, a processing fee will be charged as stated separately in the booking confirmation for group bookings. payment on site in cash or with credit card
- Payment in cash, possible in Swiss francs (CHF), euros (EUR) and US dollars (USD). Payment in EGP is only possible for Egyptian nationals who are resident in Egypt. This is at the current exchange rate from CHF to EGP. The current exchange rate is clearly displayed at the bases. It is based on the average value of buying and selling according to the official bank rate CHF to EGP.
- Payment by credit card, Credit card payments with VISA and Master Card can be made on site free of charge in either euros (EUR) or US dollars (USD). Payment by credit card in EGP is only possible for Egyptian nationals who are resident in Egypt. This is at the current exchange rate from CHF to EGP.The current exchange rate is clearly displayed at the bases. It is based on the average value of buying and selling according to the official bank rate CHF to EGP. Please note that when paying by credit card in the local currency (EGP), the conversion from CHF to EGP is based on the CHF prices. This means that the advantages and disadvantages due to currency fluctuations must be accepted.
V. Benefits/refunds
Services:
The services that the customer may purchase from SUBEX are personal and non-transferable. Detailed information on our products can be found at www.subex.org.
The execution of all programs may be subject to the following restrictions:
- natural limitations, such as natural disasters, sea conditions and weather conditions
- restrictions due to official measures
- personal limitations, e.g. health problems or abilities.
SUBEX reserves the right to change the booked program on site or to refuse.
Refund:
In principle, there is no right to a refund for services not taken.
VI. Declaration of participation
Each guest signs the declaration of participation on site. With this he confirms physical integrity and participation at his own responsibility. In the case of minors, the declaration of participation is co-signed by their legal guardians.

VII. Cancellation and No-Show
Cancellation:
Cancellation of services booked and paid for in advance is possible.
If the cancellation is made in writing at least 2 days before arrival, the booked and paid services will be refunded as follows:
Version A) Financial refund of the paid service with the deduction of a handling fee according to the amount stated in the booking confirmation.
Version B) Voucher, valid for 18 months from date of issue, for services booked and paid for in advance on the respective SUBEX basis without deduction of a processing fee.
No-Show:
Version A) If there is no written cancellation is made at least 2 days before arrival or if the customer does not show up, 50% of the services paid for in advance will be refunded.
Version B) If a reservation is made on site and the customer does not show up, 50% of the booked services will be charged.
VIII. Data protection
In general:
The protection of data and privacy of our customers is very important to us. We process only those data and to the extent necessary to provide the service and to make our services safer and better.
Use of data:
All personal information collected and stored by SUBEX will be treated in absolute confidence and will not be disclosed to third parties under any circumstances.
Security:
We secure the data by technical and organizational measures against loss, destruction, access, modification or processing by unauthorized persons. Despite regular checks, complete protection against all dangers is not possible.
IX. Website

X. Place of jurisdiction
The place of jurisdiction for all disputes is the location of the registered office.
XI. Changes
SUBEX reserves the right to make changes to our website, terms and conditions, including these GTC, at any time. For this purpose, SUBEX will list the date of the last amendment in the GTC.
In the case of a service which has already been paid for in advance, the GTCs which were valid at the time the service was paid for shall apply.
Excepted from this are measures ordered by the authorities.
